Volkswagen is still trying to figure out if cars equipped with its EA189 engine had the emissions cheating software enabled during New European Driving Cycle (NEDC) testing.

UK magazine Autocar reportedly asked VW for a comment on this matter, but the automaker refused to make one simply stating that it’s still working on a definitive list of all affected models.

The publication quotes a company spokesperson as having said “we can’t comment whether the software for the FTP75 was on specific cars used in European tests, simply because at this time, we are preparing an accurate list of models with EA189 engines. We don’t have the answer for each specific car yet.”

The same report suggests the company official shied away from making comments about how much the defeat device could have influenced the emissions numbers.

However,  European regulations for NOx (nitrogen oxide) emissions in 2009 allowed for nearly three times as much of the stuff to be legally pumped into the air -180 mg/km versus 70 mg/km in the USA, so it’s been suggested that VW may not have needed to activate the cheat sensor to pass the Euro emission tests.
