Less than a year after a CX-90 owner sued over squealing brakes, Mazda is facing another lawsuit alleging the same issue, now joined by fresh complaints about its Lane-Keep Assist system.
This latest class action was filed in Virginia by plaintiff James R. Burnell, who says his experience with the SUV unraveled almost immediately. After purchasing a new “dealership driven” CX-90, he returned it just one day later, claiming the Lane-Keep Assist system “stayed engaged inappropriately.”

Burnell says he then bought a different 2024 CX-90, only to find himself dealing with the same issues. According to the complaint, the Lane-Keep Assist system applies “inappropriate and overly ‘corrective’ steering” that actively works against the driver’s inputs.
On top of that, the SUV reportedly suffered from the same persistent brake squeal cited in last year’s lawsuit. When he brought the vehicle in for repairs in April 2024, the dealership reportedly told him everything was operating as intended.
Issues That Never End
Over the following six months, Burnell repeatedly took his CX-90 to Mazda dealerships, alleging issues with the brakes and LKA system, but was continually told there were none. Eventually, one dealership added an anti-squeal compound to the brake pads, but it failed to resolve the problem. The brakes were later replaced entirely, but the new ones also started squealing.
The lawsuit accuses Mazda of “deceptive and deplorable conduct,” alleging the company was aware of the CX-90’s brake and driver-assist issues yet failed to properly address them, instead opting to downplay or conceal the problems, Car Complaints reports.
Curiously, this class action has been filed at around the same time that the first lawsuit proclaiming the SUV has brake issues came to an end. That case, filed by CX-90 owner Daniel Green in mid-2025, was settled between the automaker and the plaintiff earlier this week, although the terms remain undisclosed.
